How it is calculated
Each September the bar councils send their proposals to the Union of Turkish Bar Associations; its board prepares the Minimum Attorney Fee Tariff (AAÜT) by the end of October and sends it to the Ministry of Justice, and it becomes final if the Ministry approves it or does not decide within a month (Attorneys Act Art. 168). The tariff in force was published in Official Gazette 04.11.2025/33067 and, under its own Art. 24, took effect on publication. In recent years the new tariff has appeared in early November. Its amounts are minimums: lawyer and client may agree a higher fee but not a lower one (Art. 1(3)). The fee a court orders the losing side to pay is also set by this tariff, and the court may raise it up to three times the tariff amount (Art. 3(1)). The tariff in force when the work is completed or judgment is given applies (Art. 21).
Fee = max(Part Three scale fee, the court’s fixed fee), not above the value; VAT = Fee × VAT rate; withholding = Fee × withholding ratePart Three slices: 16% on the first ₺600,000, 15% on the next ₺600,000, 14% on the next ₺1,200,000, 13% on the next ₺1,200,000, 11% on the next ₺1,800,000, 8% on the next ₺2,400,000, 5% on the next ₺3,000,000, 3% on the next ₺3,600,000, 2% on the next ₺4,200,000, 1% on the rest. Fixed floors: asliye ₺45,000.00, sulh hukuk ₺30,000.00, consumer ₺22,500.00, intellectual property ₺55,000.00, administrative courts ₺30,000.00 without a hearing and ₺40,000.00 with one, enforcement office ₺9,000.00. Fixed even for a monetary matter (Part Two, Section One): tax courts ₺30,000.00 without a hearing and ₺40,000.00 with one; a consumer-court case to adjust loan instalments or interest ₺20,000.00.- In tax-court cases and consumer-court loan-adjustment cases the fee is the fixed amount in Part Two, Section One, whatever the value (Attorneys Act Art. 168(2) requires a fixed fee for tax cases).
- In other cases the Part Three slices are applied to the value in order and added up.
- If the result is below the fixed fee for the court hearing the case (Part Two), the fixed fee applies (Art. 13(1)); the fee cannot exceed the amount awarded or rejected (Art. 13(2)).
- In enforcement proceedings up to ₺56,250.00 the enforcement-office fixed fee applies, never above the principal; if the debtor pays within the payment period, three quarters of the fee (Art. 11).
- In mandatory mediation that ends in agreement, the scale fee plus a quarter; up to ₺50,000.00, ₺8,000.00 plus a quarter; without agreement ₺8,000.00 (Art. 16(2)).
- VAT is added to the fee on the self-employment receipt; a client listed in Income Tax Act Art. 94 withholds income tax from the fee.
Frequently asked questions
What is the minimum fee before an asliye court?
₺45,000.00 for a non-monetary case. In a monetary case, if the Part Three amount is lower, ₺45,000.00 still applies, but the fee cannot exceed the value of the case.
How is the fee worked out in enforcement proceedings?
Up to ₺56,250.00, the enforcement-office fixed fee of ₺9,000.00, never above the principal. Above that, the Part Three slices. If the debtor pays within the payment period, three quarters of the fee (AAÜT Art. 11).
Are VAT and withholding added?
The lawyer issues a self-employment receipt with 20% VAT on top of the fee. A client listed in Income Tax Act Art. 94(1) (public bodies, corporate bodies, trading companies, joint ventures, associations, foundations, cooperatives, merchants and self-employed people bound to declare actual income, farmers keeping books) withholds 20% income tax and pays it to the tax office. People not on that list do not withhold.
Does the fee change if the case ends early?
If the dispute ends by withdrawal, acceptance, settlement or the case becoming moot before the preliminary hearing record is signed, the court awards half the tariff fee, and the full fee after it (AAÜT Art. 6). This rule is for court awards, not the lawyer’s contract; the calculator shows the full fee.
When is the next tariff published?
The current tariff was published in Official Gazette 04.11.2025/33067. The Union of Turkish Bar Associations sends the tariff to the Ministry of Justice by the end of October; it becomes final once approved or if the Ministry does not decide within a month (Attorneys Act Art. 168). Recent tariffs appeared in the Official Gazette in early November and took effect on publication under their own terms (Art. 24); the calculator uses a new tariff for dates from its start.
