Minimum mediation fee tariff: Adalet Bakanlığı (Hukuk İşleri GM — Alternatif Çözümler)
How it is calculated
The Ministry of Justice publishes the Minimum Mediation Fee Tariff in the Official Gazette at the end of December each year, in force from 1 January; the current one is in Official Gazette 26.12.2025/33119. The tariff in force when mediation ended applies (Art. 10). Mediation is a precondition for filing a lawsuit in: employee and employer claims, compensation and reinstatement cases (Law 7036 Art. 3(1)); commercial claims for a sum of money, compensation, annulment of objection, negative declaratory and restitution cases (Commercial Code Art. 5/A(1)); disputes before the consumer courts, save the exceptions in Art. 73/A(1) (Law 6502 Art. 73/A(1)); and tenancy, partition, condominium and neighbour-law disputes (Law 6325 Art. 18/B(1)). Tariff fees are minimums: a higher fee may be agreed with the mediator, and a lower one is void (Art. 1(2)). In mandatory mediation the mediator may not ask the parties for expenses (Art. 2(4)).
Agreement: Fee = max(Part Two scale fee, floor); No agreement: Fee = hours × hourly feeWith one mediator, Part Two slices: 6% on the first ₺600,000, 5% on the next ₺960,000, 4% on the next ₺1,560,000, 3% on the next ₺3,120,000, 2% on the next ₺9,360,000, 1.5% on the next ₺12,480,000, 1% on the next ₺24,960,000, 0.5% on the rest; with more mediators the rates are higher and the fee is split equally. The floor on agreement is ₺9,000.00, ₺13,000.00 in commercial and partition disputes; in mandatory mediation the fee is also never below two hours’ fee. The hourly fee is per party with two parties and a band by head count with three or more: in a labour dispute ₺1,130.00 per party with two parties, ₺2,460.00 with 3–5; in a commercial dispute ₺1,500.00 per party with two.- With an agreement, the Part Two slices are applied to the amount agreed in order; if the result is below the floor, the floor applies (Tariff Art. 7(6)–(7), Law 6325 Art. 18/A(12)).
- Without one, the meeting time is multiplied by the Part One hourly fee for the type of dispute and number of parties (Tariff Art. 7(3)).
- In mandatory mediation without agreement, the Ministry of Justice pays two hours and the parties share any time beyond equally (Law 6325 Art. 18/A(13)).
- The parties pay the fee equally unless agreed otherwise (Tariff Art. 3(1)).
- In mandatory consumer mediation, whatever the outcome, the Ministry of Justice budget covers the fee the consumer would pay; in these cases the fee may not exceed two hours’ fee under Part One (Law 6502 Art. 73/A(3)).

Who pays if there is no agreement?
In mandatory mediation, if the meetings took less than two hours or never happened, the Ministry of Justice pays two hours. Both are added to the court costs of a later lawsuit and may be charged to the losing side (Law 6325 Art. 18/A(13)). The tariff has no “half fee” rule.
