How it is calculated
A party ending an open-ended employment contract must give the other side notice in advance (Labour Law 4857, Art. 17). The party that does not observe the notice period pays notice pay equal to the wage for that period. The employer may also end the contract at once by paying the notice period in advance. No notice pay arises on termination for just cause (Arts. 24 and 25) or when a fixed-term contract expires. The periods are minimums and contracts may extend them.
İhbar tazminatı = Giydirilmiş aylık brüt ÷ 30 × İhbar süresi (gün); Net = Brüt − Gelir vergisi − Damga vergisiThe notice period depends on service: under 6 months 2 weeks, up to 18 months 4 weeks, up to 36 months 6 weeks, longer 8 weeks. Regular extras are added to pay (the “dressed” wage) and a month counts as 30 days. No social security is due on notice pay; it bears income tax like wages and stamp duty at 7.59 per mille.- Find the length of service from the first day to the termination date and pick the notice period from the table.
- Divide monthly gross pay with benefits by 30 and multiply by the days of notice.
- Work out income tax by applying the tariff on top of the tax base built up from January to the last month.
- Stamp duty is 7.59 per mille of the gross; what is left after the taxes is the net notice pay.
Example
An employee who started on 1 February 2022 and was dismissed without notice on 30 June 2026, on ₺50,000 gross plus ₺5,000 of regular benefits, has 4 years 5 months of service: 8 weeks, 56 days of notice. ₺55,000 ÷ 30 × 56 = ₺102,666.67 gross. With a January–June tax base of ₺280,500 the payment falls in the 20% bracket: ₺20,533.33 income tax and ₺779.24 stamp duty leave ₺81,354.10 net.
Frequently asked questions
How long are the notice periods?
Under 6 months of service 2 weeks; from 6 up to 18 months 4 weeks; from 18 up to 36 months 6 weeks; longer 8 weeks. The period runs from the day the notice reaches the other side.
Who pays notice pay?
The party that ends the contract without the notice period pays. If the employer dismisses without notice, it pays the employee; if the employee leaves without notice, the employee owes the employer, who usually sets it off against what it owes. There is none on termination for just cause.
What comes off notice pay?
No social security or unemployment premiums. Income tax and stamp duty at 7.59 per mille are withheld. Tax follows the base built up since January, so the rate rises for terminations late in the year: above ₺190,000 the rate is 20%, above ₺400,000 27%. The brackets are renewed every January. Enter the year-to-date base from your payslip for an exact figure.
What if notice is given?
If the employer gives notice, the employee works through the period on full pay and no notice pay arises. Paid time off to look for a new job is given each day during it. The notice period may not overlap with annual leave.
What counts as pay with benefits?
Regular extras in cash or kind are added to base gross pay: transport, meals, bonuses, premiums; a bonus paid a few times a year adds 1/12 of its yearly total to each month. One-off payments and overtime are left out.
