Working time rules: TBMM / Çalışma ve Sosyal Güvenlik Bakanlığı
How it is calculated
As a rule, working time is at most 45 hours a week (Labour Law 4857, Art. 63). Work beyond it needs the employee’s written consent; overtime may not exceed 270 hours a year, nor a working day 11 hours. Night work may not exceed 7.5 hours and no overtime may be worked at night. Workers under eighteen, pregnant, new and nursing mothers and part-timers may not be asked to work overtime. Where hours are averaged, weeks that keep the two-month average within the normal week are not overtime.
Saatlik ücret = Aylık brüt ÷ 225; Fazla çalışma = Saatlik ücret × (1 + %50) × Saat; Resmî tatil = Aylık brüt ÷ 30 × GünOvertime is work beyond 45 hours a week, paid at the normal hourly rate plus 50%. If your contract is under 45 hours, the hours above it up to 45 are “extra hours”, paid at +25%. Hourly pay is the monthly gross divided by 225 hours (45 hours a week over a 30-day month including rest days); a shorter week means proportionally fewer hours. Each public holiday worked adds 1 day’s pay on top of the salary. Under half an hour counts as half an hour, more as a full hour.- Find the hourly pay: monthly gross ÷ 225 (proportionally fewer hours if your contract is under 45).
- For each hour over 45 a week, add 50% to the hourly pay.
- For hours above your contract up to 45, add 25%.
- Add hours worked on the weekly rest day at the overtime rate.
- Add 1 day’s pay (monthly gross ÷ 30) for each public holiday worked.
Example
On ₺40,000 gross a month the hourly pay is ₺40,000 ÷ 225 = ₺177.78 and the overtime rate, +50%, ₺266.67. Ten hours of overtime come to ₺2,666.67; working one public holiday adds ₺40,000 ÷ 30 = ₺1,333.33. The month’s extra gross pay is ₺4,000.
Frequently asked questions
How is the overtime hourly rate worked out?
Monthly gross pay is divided by 225 hours and raised by 50%. With a shorter contract week the month has fewer hours, so the hourly rate is higher.
How much overtime is allowed a year?
Overtime may not exceed 270 hours a year, counted per worker, not per workplace. Even beyond the limit, overtime worked must be paid at the premium rate.
What does work on the weekly rest day pay?
The law sets no separate rate. The rest day is already paid within the monthly salary; the Court of Cassation treats work on it as overtime beyond the weekly limit, paid at +50%. The calculator counts those hours that way.
What do I get for working a public holiday?
National and public holidays are paid in your salary even if you do not work. If you work one, you get 1 more day’s pay for it; half days such as holiday eves add half a day’s pay.
Is there a night work premium?
The Labour Law sets no general night premium; it is paid if a collective or individual contract provides it. Night work may not exceed 7.5 hours; hours above the weekly limit are paid as overtime.
Can I take time off instead?
You may choose 1.5 hours off for each overtime hour, or 1.25 hours for each extra hour, instead of the premium pay. It is taken within 6 months, during working time, with no pay cut.
Is overtime pay taxed?
Overtime pay is added to the month’s gross pay and bears social security, unemployment premiums, income tax and stamp duty. To see the net effect, enter your gross with overtime in the gross-to-net salary calculator.
